These Terms and Conditions set out the rules for using the online store sklep.geoscanners.pl, placing orders, entering into sales contracts, payments, delivery, complaints and withdrawal from the contract.
§ 2. Definitions
- Customer – a natural person, legal person or organisational entity placing an order.
- Consumer – a natural person carrying out an activity not directly related to his or her business or profession.
- Sole trader entitled to consumer protection – a natural person entering into a contract directly related to their business activity, where the content of the contract indicates that it is not of a professional nature for that person.
- Product – goods, a licence, digital content or a service described in the Store.
§ 3. Electronic services
- The Store lets you browse products, use the search function, forms and cart, place orders and maintain a customer account free of charge.
- To use the Store, you need a device with internet access, an up-to-date browser and an active email address. Essential cookies must also be enabled to place an order.
- Providing unlawful content, interfering with the operation of the Store or using forms to send unsolicited information is prohibited.
- The agreement for maintaining a customer account is concluded for an indefinite period. The Customer may request deletion of their account at any time. Complaints concerning electronic services may be sent to sklep@geoscanners.pl.
§ 4. Offer, prices and orders
- Product information constitutes an invitation to enter into a contract. The Customer places an order by selecting the Product and quantity, entering the required details and choosing from the available delivery and payment options.
- Prices are shown in euros (EUR) and include VAT unless a net price is explicitly indicated in the relevant view. Before placing an order, the Customer sees the total price, including taxes and delivery costs.
- When the Store announces a price reduction, it displays the lowest price applied during the 30 days preceding the reduction alongside the reduced price, in accordance with applicable law.
- The order is placed by clicking a button indicating an obligation to pay. Until this button is clicked, the Customer may correct their details and the contents of the cart.
- After the order is placed, the Seller sends an acknowledgement of receipt. The contract is concluded when acceptance of the order for fulfilment is confirmed on a durable medium, in particular by email.
- The Store may refuse to process an order in the event of an obvious pricing error, Product unavailability, incorrect information that prevents fulfilment, or a reasonable suspicion of misuse. The Customer will be informed promptly and any payment received will be refunded.
§ 5. Payment and delivery
- Available methods, costs and expected delivery and payment times are shown in the cart or at checkout. For details, see Delivery & payment.
- For standard bank transfers, the order is processed after payment has been credited to the account. Include the order number in the payment reference. Bank account details are provided at checkout and in the order confirmation.
- The Customer should check the condition of the parcel upon receipt. Damage to the packaging does not deprive the Consumer of their statutory rights.
§ 6. Conformity of the goods with the contract and complaints
- The Seller is liable to the Consumer for any lack of conformity of the goods with the contract that exists at the time of delivery and becomes apparent within two years of delivery, unless the goods have a longer shelf life.
- The Consumer may request repair or replacement. In the cases specified by law, they may request a price reduction or withdraw from the contract. Withdrawal is not available where the lack of conformity is minor.
- Details and an optional form are available on the Complaints. The Seller will respond to the Consumer within 14 days.
§ 7. Withdrawal from the contract
- Consumers and sole traders entitled to consumer protection may withdraw from a distance contract within 14 days without giving a reason.
- Details of how the period is calculated, the effects of withdrawal, return costs, exceptions and the model form are available on the Returns and withdrawal from the contract.
§ 8. Licences, digital content and digital services
- If the contract concerns a licence, digital content or a digital service, its scope, duration, compatibility and method of delivery are specified in the Product description and order confirmation.
- The right of withdrawal may be lost before the 14-day period expires only in the circumstances specified by law, after obtaining the Customer's required prior express consent and acknowledgement of this information. Without such consent, the statutory right is retained.
§ 9. Out-of-court dispute resolution
After completing the complaints procedure, the Consumer may seek assistance from the local consumer ombudsman or Trade Inspection, or consult the information available on the UOKiK website. The Seller does not make a general commitment to participate in proceedings before a particular alternative dispute resolution (ADR) body; it decides after receiving a request relating to the specific dispute. The EU Online Dispute Resolution (ODR) platform has closed and is not listed as a channel for submitting complaints.
§ 10. Final provisions
- Contracts are governed by Polish law, without prejudice to the Consumer's mandatory rights under the law applicable to their habitual residence.
- Changes to these Terms and Conditions do not affect acquired rights or contracts concluded before the changes take effect. The current version is always available in the Store and may be saved or printed.
